Article 1. Definitions

(a) Salvage operation means any act or ac­tivity undertaken to assist a vessel or any other property in danger in navigable waters or in any other waters whatsoever

(в) Имущество означает любое имущество, временно и намеренно доставленное к берегу и содержащее фрахт за риск.

(г) Ущерб окружающей среде означает значи­тельный физический ущерб здоровью человечест­ва, жизни моря или ресурсам в прибрежных и внутренних водах или районах, примыкающих к ним, совершенный загрязнением, заражением, взрывом или подобным большим инцидентом

(д) Платеж означает любую награду, возна­граждение или компенсацию, причитающуюся по этой Конвенции

Статья 8. Обязанности спасателя. владельца и капитана

1 Спасатель обязан оказывать услуги вла­дельцу судна или имуществу в опасности

(а) провести спасательную операцию с долж­ной осторожностью,

(б) в выполнении обязанности, указанной в пункте (а), соблюдать надлежащую осторожность по защите и уменьшению ущерба окружающей среде,

(в) когда обстоятельства вынуждают, обра­щаться за помощью к другим спасателям,

(г) соглашаться на участие других спасате­лей, когда здравый смысл требует сделать это, владельцем или капитаном судна или иного имуще­ства, находящегося в опасности, однако при ус­ловии, что сумма его вознаграждения не должна уменьшаться, если будет выявлено, что такое требование было неразумным

2 Владелец и капитан судна или владелец имущества, находящиеся в опасности, обязуются перед спасателем'

(а) тесно сотрудничать с ним в период про­ведения спасательных операций,

(б) выполняя работы, проявлять должную за­боту о недопущении или сведении к минимуму вре­да окружающей среде,

(в) когда судно или иное имущество достав­лено в безопасное место, подтвердить их приня­тие, если спасателем затребовано приемлемое вознаграждение

Статья 13. Критерии для определения вознаграждения

1 Вознаграждение должно устанавливаться в виде поощрения спасательных операций с учетом следующих критериев, невзирая на последова­тельность, в которой они приводятся ниже

(а) стоимость спасенного судна и иного имущества,

(б) квалификация и усилия спасателей в предотвращении и сведении к минимуму вреда ок­ружающей среде,

(в) размер успеха, полученного спасателем,

(г) вид и размер опасности,

(д) квалификация и усилия спасателей в спасении судна, имущества и жизни людей,


(b) Vessel means any ship or craft, or any structure capable of navigation

(c) Property means any property not perma­nently and intentionally attached to the shore I me and includes freight at risk

(d) Damage to the environment means sub­stantial physical damage to human health, or to marine life, or resources in coastal, or inland waters, or areas adjacent thereto, caused by pollution, contamination, fire, explosion or similar major incidents

(e) Payment means any reward, remuneration or compensation due under this Convention

 

 

Article 8. Duties of the Salvor and of the Owner and Master

1. The salvor shall owe a duty to the owner of the vessel or other property in danger

(a) to carry out the salvage operations with due care,

(b) in performing the duty specified in subparagraph (a), to exercise due care to pre­vent or minimize damage to the environment,

(c) whenever circumstances reasonably re-quire, to seek assistance from other salvors,

(d) to accept the intervention of other salvors when reasonably requested to do so by the owner or master of the vessel or other property in danger, provided, however, that the amount of his reward shall not be preju­diced should it be found that such a request was unreasonable,

2 The owner and master of the vessel or the owner of the property in danger shall owe a duty to the salvor

(a) to cooperate fully with him during the course of the salvage operations,

(b) in so doing, to exercise due care to prevent or minimize damage to the environment,

(c) when the vessel or other property has been brought to a place of safety, to accept re-delivery when reasonably requested by the sal­vor to do so

 

 

Article 13. Criteria for fixing the reward

1 The reward shall be fixed with a view to encouraging salvage operations, taking into account the following criteria without regard to the order in which they are presented below

(a) the salved value of the vessel and other property,

(b) the skill and efforts of the salvors in preventing or minimizing damage to the envi­ronment.

(c) the measure of success obtained by the salvor,

(d) the nature and degree of the danger,

(e) the ski 11 and efforts of the salvors in salving the vessel, other property and life,



(е) затраченное время, расходы и потери, понесенные спасателем,

(ж) риск ответственности и иные риски, ко­торым подвергались спасатели и их оборудование

(з) быстрота оказанных услуг,

(и) наличие и использование судов или дру­гого оборудования, предназначенного для спаса­тельных операций,

(к) состояние готовности и эффективности оборудования спасателя и его ценность

2 Оплата вознаграждения, установленная в соответствии с пунктом 1, должна производиться всеми спасенными представителями судном и иными имущественными интересами пропорциональ­но фактической стоимости спасенного имущества

3 Вознаграждение вместе с процентами и расходами по ведению дела, которые могут быть выплачены впоследствии, не должны превышать стоимости спасенного судна и иного имущества

Статья 14. Специальная компенсация

1 Если спасатель произвел специальную операцию в то время как судно само или его груз нанесло вред окружающей среде и спасатель теря­ет право на вознаграждение согласно статье 13, по меньшей мере равное специальному штрафу по этой статье, он имеет право на специальную ком­пенсаций от судовладельца, эквивалентную его расходам

2 Если в обстоятельствах, изложенных в пункте 1, спасатель своими спасательными опе­рациями предотвратил или уменьшил ущерб окру­жающей среде специальная компенсация, выпла­чиваемая судовладельцем спасателю согласно пункту 1, может быть увеличена максимально до 30 и расходов понесенных спасателем Однако суд если найдет это справедливым и обоснован­ным, с учетом подпадающих под статью 13, пункт

1 критериев, может увеличить такую специальную компенсацию больше, но ни в коем случае общее увеличение не должно быть более 100 % расходов понесенных спасателем

3 Расходы спасателя для целей пунктов 1 и

2 означают убытки разумно понесенные спаса­телем в спасательной операции, и законная до­ля за оборудование и персонал, фактически и разумно использованные в спасательной опера­ции, принимая во внимание критерии изложен­ные в статье 13 пункт 1

4 Вся специальная компенсация по этой статье выплачивается, только если размер ее больше, чем любое вознаграждение, возмещаемое спасателю по статье 13

5 Если спасатель проявил небрежность и по­этому не принял должных мер по защите и уменьше­нию вреда окружающей среде, он может быть лишен полностью или частично любой специальной ком­пенсации в соответствии с этой статьей

6 Ничто в этой статье не должно затраги­вать любое право прибегать к помощи со стороны владельца судна


(f) the time used and expenses and losses incurred by the salvors

(g) the risk of liability and other risks run by the salvors or their equipment,

(h) the promptness of the services ren­dered,

(i) the availability and use of vessels or other equipment intended for salvage opera­tions,

(j) the state of readiness and efficiency of the salvor's equipment and value thereof

2 Payment of a reward fixed according to paragraph 1 shall be made by all of the vessel and other property interests in proportion to their respective salved values

3 The rewards, exclusive of any interest and recoverable legal costs that may be payable thereon shall not exceed the salved value of the vessel and other property

 

 

Article 14. Special compensation

1 If the salvor has carried out salvage operations in respect of a vessel which by it­self or its cargo threatened damage to the en­vironment and has failed to earn a reward under Article 13 at least equivalent to the special compensation accessible in accordance with this Article he shall be entitled to special compensation from the owner of that vessel equivalent to his expenses as herein defined

2 If the circumstances set out in para­graph 1, the salvor by his salvage operations has prevented or minimized damage to the envi­ronment, the special compensation payable by the owner to the salvor under paragraph 1 may be increased up to a maximum of 30 % of the ex­penses incurred by the salvor However, the Tribunal if it deems it fair and Just to do so and bearing in mind the relevant criteria set out in Article 13 paragraph 1, may increase such special compensation further but in no event shall the total increase be more than 100 % of the expenses incurred by the salvor

3 Salvor's expenses for the purpose of paragraph 1 and 2 means the out of pocket ex­penses reasonably incurred by the salvor in the salvage operation and a fair rate for equipment and personal actually and reasonably used in the salvage operation taking into consider­ation the criteria set out in Article 13 para­graph 1 (h), (i) and 0)

4 The total special compensation under this Article shall be paid only if and to the extent that such compensation is greater than any reward recoverable by the salvor under Article 13

5 If the salvor has been negligent and has thereby failed to prevent or minimize damage to the environment, he may be deprived of the whole or part of any special compensation due under this Article

6 Nothing in this Article shall affect any right or recourse on the part of the owner of the vessel
