If not specified separately or implied differently, for the purposes of the present Convention:

a) Private military company is an organization, established under the legislation of the State Party to provide on a compensatory basis military services by physical persons and legal entities which have a special authorization (license).

b) Private security company is an organization, established under the legislation of the State Party to provide on a compensatory basis security (guard) services by physical persons and legal entities which have a special authorization (license).

c) Military services refer to specialized services related to military actions including combat operations, strategic planning, intelligence, logistics, training, material and technical support and other.

d) Security services refer to armed guarding of property and people, elaboration and implementation of informational security measures, other activities implying use of any technical and other devices which are not harmful to people and environment in order to protect legitimate rights and interests of their clients;

e) License (authorization) is a special authorization for specified activities under the strict observance of licensing terms and obligations, which is issued by a licensing body to a legal entity or a physical person;

f) Licensing refers to measures related to the issuing of license, redrawing documents, confirming license, suspension of license in case of administrative suspension of licentiate from business for violating obligations and provisions of license, recommencement or cessation of license, withdrawal of license, control of licensing bodies over the observance of obligations and terms of license by licentiates in their activities, introduction of license registries as well as provision in an established way of information from license registries and other licensing information by interested persons.

g) License registry refers to the data pool related to the issuing of license, redrawing documents, confirming license, suspension or recommencement of license, withdrawal of license.

h) Human rights refer to civil, cultural, economic, political and social rights as set out in the International Bill of Human Rights and other international human rights instrumentsdocuments, including as well as the right tofor development and the rights confirmed under international humanitarian law, international refugee law, international labour law and other related instrumentsdocuments adopted within the system of the United Nations.

i) Export of military and/or security services refers to military and security services which a private military or security company provides outside the territory of the state in which it is registered.

j) Import of military and/or security services refers to military and/or security services which a private military or security company registered in a foreign state provides.
