International Convention on the Regulation and Oversight of

Private Military and Security Companies

The States Parties to the present Convention,

Reaffirming the purposes enshrined in the Charter of the United Nations and norms related to strict adherence to the principles of sovereign equality, political independence, territorial integrity of the state, self-determination of peoples, refusal from use of force or threat of force in international relations and non-interference into affairs which are within the domestic jurisdiction of any state,

Reaffirming their duties to prevent human rights violations ranging from legislating in accordance with human rights law obligations, the prevention of violations,, to the duty to investigate and, where appropriate, prosecute and punish offenders as well as providing adequate

rRemedies to the victims,

Reaffirming the State duty to protect all human rights abuses by, or involving, transnational corporations and other business enterprises;

Reaffirming the corporate responsibility to respect all human rights:

Worried and concerned over the threat which mercenary activity poses for peace and security,

Expressing concern at new forms of mercenarism and affirming the seemingly continued recruitment of the former military and police officers by private military and security companies to work as “guards” in the areas of armed conflict,

Convinced that notwithstanding the ways of using mercenaries or carrying out any other activities related to mercenaries or the forms such activities take to seem legitimate, they pose threat to peace, security and self-determination of peoples and hamper the exercise of all human rights by the peoples,

Determined to take all the necessary measures to stop the impunity of criminals,

Have agreed as follows:
