President of Ukraine shall remain in office until the assumption of office of the newly elected President of Ukraine.

Powers of the President of Ukraine terminated early in the event:

Resignation;

Inability to exercise authority for health reasons;

Removal from office by impeachment;

Death.

In accordance with Art. 111 of the Constitution of Ukraine:

President of Ukraine may be removed from office by the Verkhovna Rada of Ukraine on impeachment if he commits treason or other crimes.

The question of removal of the President of Ukraine from office on impeachment initiated by the majority of the constitutional composition of the Verkhovna Rada of Ukraine.

To investigate the Verkhovna Rada of Ukraine creates a special temporary investigative commission, composed of special prosecutor and special investigators.

Conclusions and proposals of the temporary investigative commission considered at a meeting of the Verkhovna Rada of Ukraine.

If there are grounds the Verkhovna Rada of Ukraine of not less than two-thirds of its constitutional composition decides to charge the President of Ukraine.

Decision to remove the President from office on impeachment adopted by the Verkhovna Rada of Ukraine of not less than three-fourths of its constitutional composition after checking case the Constitutional Court of Ukraine and getting his opinion on the compliance with the constitutional procedure of investigation and the impeachment proceedings and obtaining the opinion of the Supreme Court of Ukraine that the acts alleged against the President of Ukraine, contain elements of treason or other crime.

Thus, failure to comply with the constitutional procedure of investigation and consideration of the case for the impeachment of President of Ukraine, Viktor Yanukovych, including the absence of an opinion of the Supreme Court of Ukraine that the acts alleged against the President of Ukraine, contain elements of treason or other crime excludes ousted President of Ukraine, Viktor Yanukovych impeachment.

At the same time, other grounds for early termination of the powers of the President of Ukraine, Viktor Yanukovych, specified in subsections 1, 2 and 4 above article of the Constitution of Ukraine are also absent.

Based on the above, in accordance with the Constitution of Ukraine, the question of the appointment of the Prime Minister of Ukraine, Head of the Security Service of Ukraine, the Minister of Internal Affairs of Ukraine, the Prosecutor General of Ukraine, Chairman of the Antimonopoly Committee of Ukraine, Chairman of the State Property Fund of Ukraine, Chairman of the State Committee for Television and Radio Broadcasting, the High Command of the Armed Forces of Ukraine and other military formations, within the competence of the President and shall be settled exclusively by active participation of the President of Ukraine - Viktor Yanukovych.

In this case, since February 22, 2014 as of today, President of Ukraine, Viktor Yanukovych, took no part intended above officials, which excludes the legitimacy of their destination and as a consequence, the validity of the performance of their powers.
