Peaceful settlement of international disputes - a branch of international law, the principles and rules which define the procedure for settling disputes between subjects of international law (states and international organizations) by peaceful means

There are main means of peaceful settlement of disputes:

 

Negotiation - the most flexible and effective means, as all issues of substance and procedure agreed upon by the disputants.

Survey - assessment of the actual circumstances of the dispute international investigative commission formed on a parity basis by the contesting parties.

Reconciliation (conciliation) - assessment of the facts and make recommendations to resolve the dispute. Conclusions and recommendations of the conciliation commission are optional.

Good services - third party action not involved in the dispute (states, international organizations, authoritative personality) aimed at establishing contacts between the disputing.

Mediation - third party involvement in the peaceful settlement of the dispute. The mediator is an equal participant in the negotiations.

 

International Law of the Sea.

International law of the sea - a set of principles and legal norms establishing a regime of maritime spaces and regulating relations between states on the use of the oceans. Currently, most of the rules of international law of the sea are combined in the UN Convention on the Law of the Sea 1982. All other international treaties contain provisions concerning the industry, mainly complement or detail the provisions of the Convention.

The principle of freedom of the seas is one of the oldest in international maritime law. No state can claim to domination of the high seas or part of their sovereignty.

Freedom of the high seas includes:

freedom of navigation;

freedom of over flight;

freedom of pipelines and cables;

freedom to construct artificial islands and other installations;

freedom of fishing;

freedom of research;

Ship on the high seas is subject to the exclusive jurisdiction of its flag State and in its lawful activities may not interfere with anybody, except when:vessel engaged in piracy;

Ships engaged in the slave trade;

the ship is engaged in unauthorized broadcasting, ie, transmits in violation of international radio and television broadcasts intended for making population

the ship is without nationality (sailing without a flag)
