In ______ law, ritual and nonritual transgressions were crimes punishable by court. Each of the 36 most severe ________(e. g., adultery, sodomy, idolatry, sorcery, or murder) carried one of four ______ of death penalty (stoning, burning, _______, and strangling). Rabbinic law, however, tended to minimize the practice of capital punishment. The rigorous cross-examination of witnesses and the warning of impending ______, that the transgressor had to receive immediately before committing his ______, made it almost impossible to reach a death verdict.

The punishment for 207 other transgressions (e.g.: ______, some forms of incest, the eating of forbidden foods) was ______. Here, too, the rabbis tended to be lenient. As in capital cases, a ______cross-examination and a warning were required. The maximum number of stripes administered was 39. Prior to flagellation the transgressor was ______ medically to determine the number of stripes he could withstand.

These two punishments were ______ used in Babylonia, where ordained courts did not exist. It should be mentioned also that the Mishna includes a few obscure references to a form of ______ used instead of capital punishment. The Israeli penal code includes the death penalty as a punishment for _____ crimes, such as terrorism, war crimes, ______, mass murder, and genocide. In the history of Israel, only one death sentence has been carried out: that of Adolph Eichman, a Nazi war ______ convicted of genocide. Other death sentences have been issued, but were later overturned on appeal.

After its _____ of the West Bank and Gaza, the Israeli military _____ the issuing of the death penalty in the Occupied Territories by the criminal courts, despite the fact that the legal _____ of the West Bank (Jordanian and Mandate law) and Gaza (Egyptian and Mandate law) include the death penalty for some serious crimes. _____, the Gaza-Jericho Agreement (signed in 1994) forbids Israel to transfer suspects to the Palestinian ______ unless it is assured that the suspect will not face the death penalty.

This legal _____ is of course balanced by the practice of extra-judicial executions, which have been used by the Israeli _____ and the General Security Services (GSS) since the establishment of the state of Israel. The Israeli undercover units operating in the Occupied Territories since the Intifada have been accused _____ of following a policy of summary executions. This accusation has been documented by Israeli, Palestinian, and international human rights groups. The Israeli government was justly condemned as responsible for the deaths caused by these units.

You are going to read the text about the reasons for committing crimes. Choose the most suitable heading from the list (A—F) for each part (1—5) of the text. There is one extra heading which you do not need to use. The Cause of the Crime

A Human treatment of criminals D Convicted felons
B Taking a turn for the better E The picture is not so rosy as it appears
C The root of all evil F Crime doesn't pay

1 Are you worried about crime? I am. We read it every day in the papers. A terrible crime has been committed, the police have arrested someone, he has appeared in front of a jury in court, he has pleaded his innocence but has been found guilty of his crime and he has been sentenced to ten years in prison. We are all very relieved that the criminal is being punished for his misdeeds, and innocent citizens like you and me can sleep more safely at night.

2 But what happens next? We all hope, don't we, that the prisoner will benefit from society's retribution, that a spell in prison will rehabilitate him and make him a better person. We all hope that he will reform and become like us. We all hope that when he is eventually released and let loose on the streets, he will be a good character, the threat of another spell in jail being a suitable deterrent which will stop him from breaking the law again. Oh yes.

3 But let's face it. The reality is usually very different. The prisoner may be released on parole, before the end of his sentence. He will try to re-enter society. But then he often becomes a victim himself, unable to find work and rejected by society. It isn't long before he's back in prison again.

4 So what alternatives are there, I hear you say? What can we do to the offender to make sure he doesn't commit another crime? There are alternatives to prison, of course, such as community service in which he will provide a service to those around him. Or he can pay a large fine. Alternatively, we could establish a more severe system of punishment, including corporal punishment and capital punishment, but we like to consider ourselves civilized, and the idea of beating or executing someone is repellent to us. Oh yes.

5 The answer, of course, is far simpler. We need to be tough not on the criminal, but on the cause of the crime. We should spend less of the taxpayer's money funding the judges and solicitors and all the other people who work for the legal system, and put the money instead into supporting deprived areas which are the breeding grounds for crime. We believe that everybody needs a good chance in life, and this is a good step forward.
