Agenda: “Indigenous Sovereignty and Rights in the 21th Century”

Human Rights Council,

deeply worrying about the currently existing situation concerning the condition of the indigenous peoples in twenty-first-century society,

remembering conflicts connected with relations between indigenous peoples and national governments, and regretting their sorrowful consequences,

particularly aware of the necessity of preventing such conflicts in the future,

noting our deep apprehension about the spreading the precedents with indigenous people in different parts of the world,

considering that the peace and the upheld development and progress are unconditionally connected with rights and freedoms of indigenous peoples,

referring to the basics of international law declared in the The Charter of the United Nations adopted in 1945, art. 1 of the International Covenant on Civil and Political Rights adopted in 1966 and the United Nations Declaration on the Rights of Indigenous Peoples, adopted by General Assembly on 13 September 2007,

apprehending the possibility of future bloody conflicts caused by incorrect interpretation of the sense of the right of sovereignty and self-determination,

emphasizing the importance of self-determination within the framework of the existence of current states and inviolability of the borders of current states,

respecting the international law and expressing undisputed respect to all delegates of United Nations,

1. suggests accepting the following definition of the term “indigenous peoples”: this kind of community should be considered as a social unity, members of which identify themselves as a distinct indigenous cultural, social and spiritual group with their own traditions and language, who historically have inhabited a specific territory at the pre-invasion or pre-colonial times and are strongly linked to this territory and surrounding natural resources; or led nomadic life but identify themselves as a distinctive cultural society

2. underlines the distinguishing the terms “indigenous peoples” and “ethnic minorities” taking into consideration the fact that the origin of minor ethnic groups may not be connected with original inhabitance on the exact territory and the absence of the significant interaction of minorities’ lifestyle is also possible;

3. recommends to all the nations to grant indigenous peoples a legal status presuming its unique discarnate immaterial value, expressed in existence of their own language, culture and folklore. Referring to this statement we recommend involving the indigenous peoples’ existing and welfare into an area of responsibility of UNESCO;

4. further invites all the nations to consider the indigenous peoples as an inalienable part of worlds heritage and to share financial responsibilities for their support among all other nations;

5. insistently recommends to the states to adhere to the principle of border inviolability, i.e. even if indigenous peoples have some specific rights over the lands they inhabit and the right of self-administration, separatism is unconditionally unacceptable;

6. solemnly affirms that our duty is to give them a chance to provide them with all possible opportunities for harmonious development in accordance with their traditions and to give an opportunity to find their place in the modern society as an equal subject but not as a patronized one;

a. considering that this target can primarily be achieved by providing indigenous peoples with the high-quality and equal educational opportunities and with prior consultations with indigenous peoples, if the government's actions may violate their rights;

b. suggesting to all the countries Human Rights Council Observer should be posted to preserve the rights of indigenous people

7. expresses its hope that indigenous communities will not follow the way of isolation, because we do believe that this way leads to distinction between nations in our modern world. It is impossible to revive innocence of the nation's youth and we all need to move forward together to reach a better world;

8. supports the states in creating a stable and constitutionally provided ground for indigenous peoples for their self-organization, equal rights in governmental regulation and their participation in legislative business, elaborating the idea of self-administration;



9. advises states to create an Annual International and Regional Forums for all the indigenous peoples as an instrument of global communication and cooperation with a participation of experts from global organizations, who will provide legal assistance for indigenous peoples. Moreover, in the frameworks of this Forum’s activity, it will be possible to improve interaction among governments of the states, domestic governmental and non-governmental organizations;

10. endorses as an instrument for preserving indigenous peoples’ unique culture and languageany domestic investments into educational programs for indigenous peoples conducted in their traditional language;

11. confirms the right to name a certain community as "indigenous" to the appropriate governmental structures of the state, on which territory potential one inhabits;

12. emphasizes the necessity an Expert Community, established by the consensus of HRC countries, and which role is supposed to create an impartial evaluation on the question of indigenous status of some community. Every nation is supposed to have a right to ask this community for such evaluation.
