Groundwork of the Metaphysics of Morals, The Critique of
Practical Reason, and The Metaphysics of Morals. It also
examines the relation of Kant's philosophy to politics.
Collectively, the essays in this volume provide English readers
with a direct view of how leading German philosophers are now
regarding Kant's revolutionary practical philosophy, one of the
outstanding achievements of German thought.

4 x 15,0 cm.-(Law in Eastern Europe; No. 61).-Index: p.
297 - 311.

One of the most widespread problems in post-Communist
countries is the quality of the judiciary. The book argues that
these problems are intimately linked to the legal culture of
Communist law, that an understanding of post-Communist judges
necessarily requires an understanding of their Communist
predecessors. There seems to be a deep continuity in the methods
of legal reasoning employed by lawyers in the region of East
Central Europe, starting in the era of Stalinism of the 1950s up
to the current post-Communist period, which continuity is
manifested in the problems of 1990s and 2000s. Communist legal
culture and its aftermath provide an interesting analysis of the
development of legal culture in a long-lasting system which was
intellectually almost completely separated from the outside
world. The book targets the judicial ideology, the conception of
law, and the judicial self-perceptions, which are phenomena most
likely to be contained in the deepest level of legal culture,
that most resistant to change.

СОДЕРЖ.: Part I. Ancient Roman Law: 2. Suum Cuique Tribuere (

Tradition: 3. Correctio (The Early Middle Ages, c. 500–1000) --

Modern Age, 1648–1914) -- 7. Voluntas (The Post–Modern Age,
1914–2004).

The rediscovery of Roman law and the emergence of classical
canon law around AD 1100 marked the beginnings of the civil law
tradition in Europe. Between the twelfth and eighteenth
centuries, a highly sophisticated legal science of a truly
European dimension was developed. Since then the different
European States have developed their own national legal systems,
but with the exception of England and Ireland they are all heirs
to this tradition of the ius commune. This historical
introduction to the civil law tradition, from its original Roman
roots to the present day, considers the political and cultural
context of Europe's legal history. Political, diplomatic and
constitutional developments are discussed, and the impacts of
major cultural movements, such as scholasticism, humanism, the
Enlightenment and Romanticism, on law and jurisprudence are
highlighted. This contextual approach makes for a fascinating
story, accessible to any reader regardless of legal or
historical background.

СОДЕРЖ.: Part 1. The Bramble Bush -- Part 2. The Other Side.

This book is targeted towards law students, the parents of law
students, scholars, and undergraduate professors who would
recommend it to their up-and-coming law students as additional
reading.

For over 70 years, prospective and enrolled law students have
been assigned to read a text that prepares them what they are
about to encounter. That text is Bramble Bush. This classic
answers questions that all students have when starting law
school, and virtually takes them inside the classroom like no
other text. It gives factual examples, detailed information, and
practical explanations. Bramble Bush is required reading in
numerous law schools and is recommended by many Law School Deans.

An outgrowth of Professor Llewellyn's introductory lectures at
Columbia University School of Law, Bramble Bush continues to be
the best introduction to the study of law for both potential and
enrolled law students.

undergraduate student in mind, providing a full insight into
legal terminology and ensuring students are familiar with terms
they will encounter during their studies. The dictionary
includes substantial entries on core student topics which
outline the conceptual importance of key areas, to give students
an idea of how these terms have been shaped by, and in turn
shape, how lawyers think. Some older terms are also included, as
although they are not used to frame the current law, students
will come across them in the course of their studies and they
are of historical significance. The text features cross-
referencing of terms and definitions, giving students the

material is presented in a new two-colour page design, which

between theory and practice in comparative legal studies. Essays
by both established and younger comparative lawyers reflect on
the methodological challenges arising in their own work and in
work in their area. Taken together, they offer clear
recommendations for, and critical reflection on, a wide range of
innovative comparative research projects.

Lawyers and legal academics interested in the life and work
of Blackstone - the most prominent figure in the development of
English and American common law. Historians interested in
eighteenth century legal, social, political and literary history,

Blackstone's personal history and public life crosses all
areas of eigteenth century social and literary life. Educational
historians interested in the history of Oxford University.

Lawyer, judge, politician, poet, teacher, and architect,
William Blackstone was a major figure in eighteenth century
public life. Over his varied and brilliant career he made
profound contributions to English politics, law, education, and
culture through involvements in legal practice, Parliament, and
the University of Oxford. Throughout he also remained engaged in
his society's literary and spiritual life. Despite the breadth
and influence of his work, Blackstone the man remains little
known and poorly understood, the lack of engagement with his
public and private life standing in stark contrast to the scale
of his influence, particularly on the development and teaching
of the law.Blackstone's 'Commentaries on the Laws of England'
remains the most celebrated and influential text in the Anglo-
American common-law tradition. This great book has inevitably
overshadowed its author, while the dispersal of his personal and
professional papers further complicates the task of
understanding the man behind the work. The lack of a thorough
account of Blackstone's life has fuelled controversy surrounding
his intellectual background and political views. Was he the
deeply reactionary conservative painted by Bentham, or rather a
committed reformer and early champion of human rights?

The chapters in this volume are from two Leiden conferences.
There, distinguished scholars and practitioners from Russia and
the Far Abroad measured the winds of change in the field of
private law in post-Soviet Russia: enormous differences from the
Soviet period, crucial in supporting post-Soviet changes toward
freedom of choice in the marketplaces of goods, services, ideas
and political institutions. This volume will enable the reader
to further chart the progress made in Russia (and the region) in
the revitalization of private and civil law—and its impact upon
practice and comparative legal studies—and to appreciate the
role which the distinction between the public and private
sectors is seen as playing in the process.

Bibliogr.: p. 239 - 250.

СОДЕРЖ.: Part I. The Soviet Challenge -- Part II.
Accommodation in the West -- Part III. The Bourgeois
International Order: -- Part IV. Law Beyond the Cold War.

This book was first published in 2007. The government of
Soviet Russia wrote new laws for Russia that were as
revolutionary as its political philosophy. These new laws
challenged social relations as they had developed in Europe over
centuries. These laws generated intense interest in the West. To
some, they were the harbinger of what should be done in the West,

hence a source for emulation. To others, they represented a
threat to the existing order. Western governments, like that of
the Tsar, might be at risk if they held to the old ways.
Throughout the twentieth century Western governments remade
their legal systems, incorporating an astonishing number of laws
that mirrored the new Soviet laws. Western law became radically
transformed over the course of the twentieth century, largely in
the direction of change that had been charted by the government
of Soviet Russia.

Maitland, Pound, and Pound's Successors.

This is a study of the central role of history in late
nineteenth-century American legal thought. In the decades
following the Civil War, the founding generation of professional
legal scholars in the United States drew from the evolutionary
social thought that pervaded Western intellectual life on both
sides of the Atlantic. Their historical analysis of law as an
inductive science rejected deductive theories and supported
moderate legal reform, conclusions that challenge conventional
accounts of legal formalism. Unprecedented in its coverage and
its innovative conclusions about major American legal thinkers
from the Civil War to the present, the book combines
transatlantic intellectual history, legal history, the history
of legal thought, historiography, jurisprudence, constitutional
theory and the history of higher education.
