In recent years the counterfeiters have gone from strength to strength. Some see the rise in counterfeiting of goods as an inevitable product of globalization.

There are several reasons why it happens.

The first, more and more companies, in effort to increase profits, move manufacturing to the cheaper labor markets of the third world, where there are weaker labor laws or environmental regulations. As a result reduced control and some counterfeits are produced at the same factory that produced the original, using the same materials. As counterfeiters of the get their goods by bribing employees in a company.

Secondly is a new technology. Where once counterfeits were cheap and shoddy almost indistinguishable from genuine article.

In the third, the internet has been a great help to counterfeiters. It gives them detailed information about which goods to copy and allowing them to link consumers and suppliers with ease. More internet allows to distribute fakes and copycats.

 

Today each of us is infringing anyone’s right. We download music daily and do not think about infringement copyright. Because it is not advantageous to buy an expensive CD disk for a favorite song. And peer-to-peer sharing is more accessible because the sore may not be what we want. But our actions are detrimental to individuals.

Therefore, you must consider the basic concept of copyright infringement and intellectual property theft, that we break even knowing.

Copyright Infringement: is the unauthorized use of copyrighted material in a manner that violates one of the copyright owner’s exclusive rights. There are many different ways copyright owners may find their copyright has been infringed. For example, in the film and music industry, infringing activities include the following:

piracy;

counterfeiting;

forgery;

bootlegging;

plagiarism

Piracy – the illegal copying of music products that have been released without permission from the copyright owner. Pirate products are not necessarily packaged in the same way as the original, as opposed to counterfeit products.

Counterfeiting involves duplication of both the music product and of its packaging.

Forgery is the process of making, adapting objects, statistics, or documents with the intent to deceive. When we speak of forgery we usually refer to money, paintings or documentation such as diplomas or passports.

Bootlegging is where recording are made of live performances without the performers’ consent.

Plagiarism is theft of another person’s writings or ideas. Generally, it occurs when someone steals expressions from another author’s composition and makes them appear to be his own work

Legal protection of intellectual property:

Trade marks are symbols (like logos and brand names) that distinguish goods and services in the marketplace. (TM)

A patent is an intellectual property right, granted by a country’s government as a territorial right for a limited period. Patent rights make it illegal for anyone except the owner or someone with the owner’s permission to make, use, import or sell the invention in the country where the patent was granted.

Identification marks. These phrases have no legal effect, but only give information that an application for patent has been filed in the Patent and Trademark Office. The protection afford by a patent not start until the actual grant of the patent

Why should you avoid buying fakes?

The goods may be dangerous – from cosmetics that can cause skin rashes to fake car parts that may cause accidents.

You may be putting local people out of jobs because genuine manufacturers can’t compete with the criminals making and selling fakes.

If you buy fake goods and they don’t live up to your expectations, you won’t get any after sales service or guarantees.

Fake goods deprive the copyright owner of money that can be used to fund new development.
